Terms of Service

These terms of service govern your use of the Bird Call Identifier website and the Bird Call Identifier iPhone app, operated by Soufiane Benabid (benabid.me). By using the website or the app, you agree to these terms. If you have any questions, email contact@birdcallidentifier.com.

The service

Bird Call Identifier helps you identify birds by sound, photo, or description, keep a personal life list of sightings, and explore species information. The app is free to download and use, with a premium subscription that unlocks the full experience. Free use may include fair-use limits, such as a limited number of identifications per day; these limits can change over time.

Identification results

Identifications are produced by automated recognition systems and are provided for general informational and educational purposes. While the app is designed to be accurate, no identification system is perfect. Results are suggestions, not certainties, and should not be relied upon where a mistake could have legal, safety, scientific, or commercial consequences — for example, deciding whether an animal is safe to approach or handle.

Subscriptions and billing

  • Plans. Premium is available as an auto-renewing subscription (for example weekly or yearly). Current prices are always shown in the app before you buy and may vary by region.
  • Billing. Payment is charged to your Apple ID account at confirmation of purchase, and the subscription is managed entirely by Apple.
  • Auto-renewal. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
  • Cancelling. You can manage or cancel your subscription anytime in your App Store account settings. Cancelling stops future renewals; the current period remains active until it ends.
  • Refunds. Purchases are processed by Apple, and refund requests are handled by Apple under its own policies at support.apple.com/billing.

Your content

You keep ownership of the recordings, photos, and descriptions you submit. By submitting content, you grant us the limited rights needed to process it, return results to you, store your sightings, and operate and improve the service. We do not use your content for advertising.

Acceptable use

  • Do not attempt to disrupt, overload, or gain unauthorized access to the service.
  • Do not use the service to infringe the rights of others or to violate any law.
  • Do not scrape, harvest, or bulk-download content from the website or app.
  • Do not reverse engineer, resell, or misrepresent the service as your own.

Intellectual property

The website, the app, and their content — including text, design, logos, and software — are protected by intellectual property laws and may not be copied, modified, or redistributed without permission, except as allowed by law. Species photographs and community observations shown in the app come from public biodiversity platforms and remain subject to their own licenses and attributions.

Disclaimer of warranties

The website and app are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee that the service will be uninterrupted, error-free, or that every identification will be correct.

Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the website or app. Nothing in these terms limits liability that cannot be limited by law, and nothing affects your statutory rights as a consumer.

Termination

You can stop using the service at any time by deleting the app. We may suspend or terminate access to the service for use that violates these terms or harms the service or other users.

App Store terms

The app is distributed through the Apple App Store, and your use of the app is also subject to the applicable App Store terms and Apple's standard licensed application end user license agreement.

Changes to these terms

We may update these terms from time to time. When we do, we will revise the date at the top of this page. Continued use of the website or app after a change means you accept the updated terms.
