Terms of Service

These terms govern your use of Bird Call Identifier mobile applications, website, and related services, operated by Soufiane Benabid (benabid.me). By using the service, you agree to these terms. Questions may be sent to contact@birdcallidentifier.com.

The service

Bird Call Identifier helps you identify birds by sound, photo, or description, keep a personal life list of sightings, and explore species information. The app is free to download and use, with a premium subscription that unlocks the full experience. Free use may include fair-use limits, such as a limited number of identifications per day; these limits can change over time.

Identification results

Identifications are generated automatically by our proprietary bird-identification technology, developed specifically for Bird Call Identifier using a global reference database of bird sounds, visual characteristics, geographic ranges, habitats, and seasonal patterns. Although the system is designed for accurate results, no automated identification is infallible. Results are suggestions for general informational and educational use and must not be relied upon where an error could have legal, safety, scientific, or commercial consequences.

Subscriptions and billing

  • Plans. Premium is available as an auto-renewing subscription (for example weekly or yearly). Current prices are always shown in the app before you buy and may vary by region.
  • Billing. Payment is charged through the app marketplace or payment provider shown at checkout and is subject to that provider's terms.
  • Auto-renewal. Subscriptions renew automatically unless cancelled within the period specified by the applicable marketplace or payment provider before the current term ends.
  • Cancelling. You can manage or cancel through the marketplace or provider used to purchase the subscription. Cancelling stops future renewals; access ordinarily continues until the current paid period ends.
  • Refunds. Refund eligibility and requests are governed and handled by the marketplace or payment provider that processed the purchase, except where applicable law requires otherwise.

Your content

You retain ownership of photos, recordings, and descriptions you submit. By submitting content, you grant us the limited rights required to transmit and process it automatically, generate the requested result, and operate the service. Identification photos, recordings, and descriptions are automatically deleted from the backend after processing, are not placed in a model-training dataset, and are not used for advertising. Life List details you choose to retain are handled as described in our Privacy Policy.

Acceptable use

  • Do not attempt to disrupt, overload, or gain unauthorized access to the service.
  • Do not use the service to infringe the rights of others or to violate any law.
  • Do not scrape, harvest, or bulk-download content from the website or app.
  • Do not reverse engineer, resell, or misrepresent the service as your own.

Intellectual property

The service and its content—including its proprietary identification models, matching technology, databases, software, text, design, and logos—are protected by intellectual property laws and may not be copied, modified, reverse engineered, or redistributed without permission, except as allowed by law. Any separately attributed third-party reference content remains subject to its applicable license.

Disclaimer of warranties

The website and app are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee that the service will be uninterrupted, error-free, or that every identification will be correct.

Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the website or app. Nothing in these terms limits liability that cannot be limited by law, and nothing affects your statutory rights as a consumer.

Termination

You can stop using the service at any time by deleting the app. We may suspend or terminate access to the service for use that violates these terms or harms the service or other users.

Marketplace terms

If you download or purchase the app through a third-party marketplace, your use and purchase are also subject to that marketplace's applicable terms and licensed-application rules. If those rules conflict with these terms, the marketplace rules apply only to the extent required for your use of that marketplace.

Changes to these terms

We may update these terms from time to time. When we do, we will revise the date at the top of this page. Continued use of the website or app after a change means you accept the updated terms.
